Job Description and Duties

Under the general direction of the State Librarian, the Attorney III (Legal Counsel) Retired Annuitant, will be responsible for providing the full range of legal services to the California State Library, the California Library Services Board and bureau management.

This position is designated under the Conflict of Interest Code. The position is responsible for making or participating in the making of governmental decisions that may potentially have a material effect on personal financial interests. The appointee is required to complete Form 700 within 30 days of appointment and once per year. Failure to comply with the Conflict of Interest Code requirements may void the appointment.

Working Conditions

Incumbents work in an office setting, with artificial light and temperature control. Daily access to and use of a personal computer and telephone (80+%) is essential. Computer work is not typically heavy or repetitive. The Attorney III is expected to travel occasionally (=10%), when necessary to visit the State Library's San Francisco site, attend board meetings throughout the state, forums and meetings or to provide consultation, etc. The position requires bending and stooping to retrieve files; occasional light lifting, up to 10 – 15 lbs.

Special Requirements

Appointments shall not exceed a maximum of 960 hours in any fiscal year (July-June) without reinstatement, loss or interruption of benefits.  Position will be filled based on budget approval. A retired person shall not be eligible for employment as an RA for a period of 180 calendar days after the date of retirement unless the appointment is necessary to fill a critically needed function. The 180-day waiting period does not apply to:

  • A retired peace officer or firefighter hired to perform functions regularly performed by a peace officer or firefighter.
  • A retiree who takes office as a judge of a court of record or a retiree under the Judges’ Retirement System I/II who is appointed as a retired judge.

A retired person cannot be appointed as an Retired Annuitant if, during the 12-month period prior to the appointment, they received unemployment insurance based on state employment. This prohibition covers all state departments and other public employers that provide retirement benefits under CalPERS.
