Job Description and Duties

The Natural Resources Law Section is seeking candidates who have demonstrated interest and experience advising clients and litigating in matters involving the federal Clean Air Act, the federal Clean Water Act and the California Porter-Cologne Act, the federal and California Endangered Species Act, and/or NEPA and CEQA. Familiarity with the federal Administrative Procedures Act (APA) is a plus. Candidates should have strong research and writing abilities as well as experience leading complex, often technical scientific discovery, and drafting dispositive and substantive motions in state and federal courts (i.e. demurrer, motion to dismiss, motion for summary judgment, motion in limine, etc.). This position requires strong interpersonal communication skills and the ability to provide competent and reliable service to a large number of state client agencies and their in-house counsel in affirmative and defensive litigation settings.

The Natural Resources Law Section advises and represents California state agencies, boards, commissions, and Agricultural Associations with responsibility for natural resources management and regulation, pollution control, and fire and emergency response cost recovery. Our attorneys practice throughout the state of California and often appear nationwide in important, highly visible federal actions. Among the many client agencies we represent the California Air Resources Board, the State Water Resources Control Board, the Regional Water Quality Control Boards, the Department of Fish and Wildlife, the Fish and Game Commission, the Department of Water Resources, CAL FIRE, the Board of Forestry, the Department of Pesticide Regulation, CalRecycle, the Department of Food and Agriculture, and other state entities. The subject matter of the representation includes air pollution and climate control, water quality standards, water rights and water supply, CEQA, endangered species, fire suppression cost recovery, timber harvest plans, landfills, agricultural matters, and business matters such as bankruptcy, collections, contracts, and white collar fraud.

Ideal candidates will have civil litigation experience and in areas involving the federal Clean Air Act, the federal Clean Water Act and the California Porter-Cologne Act, the federal and California Endangered Species Act, and/or NEPA and CEQA. Candidates should have a demonstrated ability and experience in developing litigation plans, managing case loads, and managing expert and percipient witnesses. Desirable candidates will possess excellent research and writing skills, as well as skill in oral advocacy and negotiations. Candidates should be highly motivated to work on environmental matters. Candidates should be well organized and detail oriented, and be able to work under tight deadlines and pressure. We are seeking candidates who have a positive attitude, are team players, have an excellent work ethic, and are willing and able to take direction. The ability to work well with a variety of personalities is crucial. NRLS deputies are expected to behave with the highest level of professionalism, including in high stress situations, and be able to foster and maintain good relations with clients. Experience in the management of discovery documents in an electronic database is preferable. A background in federal and state environmental and natural resources law is desirable.
