Job Description and Duties

The Deputy Attorney General III (DAG III) position performs complex legal work in the Bureau of Medi-Cal Fraud and Elder Abuse (BMFEA), prosecuting criminal cases of elder abuse and Medi-Cal fraud in state courts. Areas in which cases are brought include, but are not limited to, the systemic neglect of elder and dependent adults residing in facilities and fraud involving the delivery of, and/or billing for, Medi-Cal services. Duties include, but are not limited to, preparing for and litigating criminal cases in state courts; overseeing criminal investigations; performing a variety of difficult legal research; sometimes working with District Attorney Offices in California and Attorney General Offices in other states in joint actions. In multi-disciplinary actions, acts in a senior advisory role performing legal duties and collaborating with other agency investigators and attorneys relative to elder abuse and fraud. In addition, this position requires acting as a team member with BMFEA investigative auditors and special agents at all stages of BMFEA investigations and prosecutions.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
Experience, knowledge, and ability investigating, litigating, and trying complex criminal or civil cases, developing case plans, working with large amounts of documents and data, analyzing and proving corporate conduct, managing case loads, and conducting and coordinating investigative activities, including case preparation and expert witness management. Demonstrated success as a team player who works well with others. Proven initiative and an excellent work ethic. Experience in and knowledge of health care law, the health care business, and the Medi-Cal program would be helpful, as would experience in elder law or medical malpractice prosecution.
